As Butler explains, "Within speech act theory, a performative is that discursive practice that enacts or produces that which it names" (Bodies 13). A speech act can produce that which it names, however, only by reference to the law (or the accepted norm, code, or contract), which is cited or repeated (and thus performed) in the pronouncement.

Gender Trouble: Feminism and the Subversion of Identity is a book by the philosopher Judith Butler, in which the author argues that gender is a kind of improvised performance. The work is influential in feminism, women's studies, and lesbian and gay studies, and has also enjoyed widespread popularity outside of traditional academic circles. Butler's ideas about gender came to be seen as foundational to queer theory and the advancing of dissident sexual practices during the 1990s.

Judith Butler: performativity and dramaturgy. Dr Jena A Zelezny (2010) Judith Butler’s work is widely known and sometimes only known, for the theory outlined in ‘Performative Acts and Gender Constitution: An Essay in Phenomenology and Feminist Theory’ (Theatre Journal 1988), Gender Trouble: Feminism and the Subversion of Identity (1990), and Bodies that Matter: On the Discursive Limits Performative Acts and Gender Constitution: An Essay in Phenomenology and Feminist Theory Judith Butler Philosophers rarely think about acting in the theatrical sense, but they do have a discourse of 'acts' that maintains associative semantic meanings with theories of performance and acting.

Identity itself, for Butler, is an illusion retroactively created by our performances: "In opposition to theatrical or phenomenological models which take the gendered self to be prior to its acts, I will understand constituting acts not only as constituting the identity of the actor, but as constituting that identity as a compelling illusion, an object of belief" ("Performative" 271). He is the first person who divided language into two types: constative and performative. (Butler, 2004) John Searle’s theory of ‘speech act’, the phenomenological theory of ‘acts’ and Simone de Beauvoir’s notion on “one is not born a woman, but rather becomes one” (de Beauvoir, 1978) influenced Judith Butler to propose her In arguing that gender is performative, Butler drew from a tradition in the philosophy of lan-guage. The publication in 1962 of J. L. construction works, Butler claims that gender is performative. To understand the meaning of her claim, first the general concept of performativity needs to beexplained. Then is discussed what ‘gender is performative’ means. If gender is performative it is continuously subject to small changes and keeps constituting itself.

The publication in 1962 of J. L. Austin’s (1911–60) How to Do Things With Words argued that language does not merely reflect speakers’ perception of reality, rather that speakers may use language to instantiate reality: in other words, Judith Butler is an American post-structuralist and feminist philosopher who has contributed to the fields of feminism, queer theory, political philosophy and ethics. She is currently a professor in the Rhetoric and Comparative Literature departments at the University of California, Berkeley. Butler's essential point in "“Performative Acts and Gender Constitution" is that acts assigned with gender significance (like wearing make-up, for example) should not be treated as "natural" and that a careful critical scrutiny of them can go a long political way for gender equality and liberation.
